The sentence "The Highways Act 1980 prohibits anyone crossing a footway with a motorised vehicle" does not seem to be consistent with the language used in the act and it must therefore be assumed that this phrase is an interpretation made by the writer and if this is the case then the section/schedule that it is based on needs to be quoted. I think you should write back to them saying that having consulted the act you have been unable to find any part of the act with such a prohibition and would like to know which sections/schedules they think are relevant.

I believe they are being disingenous using that statement and know very well that such a prohibition does not exist as they state, whereas had the said "prohibits anyone crossing a footway by driving with a motorised vehicle" they may be more accurately reflecting the act but in so doing lose their argument against you.

The sentence about giving permission to break the law has absolutely no relevance to whether the bike is parked legally or not and they has better be very careful about accusing you of breaking the law.

In short looking at what you have repeated of their letter it is entirely unsatifactory as a response, and totally specious.
